MediaPilot Creator Terms of Service

1. Overview
These Terms of Service ("Agreement") govern your use of the MediaPilot platform ("MediaPilot," "we," "us") as a content creator or media brand ("Creator," "you").
MediaPilot enables creators to build, distribute, and monetize Smart TV (CTV) channels across supported platforms.
By creating an account or using the platform, you agree to these terms.
2. Eligibility
You must:
- Be at least 18 years old
- Have the legal right to distribute all content you upload
- Comply with all applicable laws and regulations
MediaPilot reserves the right to approve or reject any account.
3. Platform Services
MediaPilot provides:
- Smart TV app and channel creation
- Content hosting and distribution
- Ad monetization and revenue generation
- Analytics and performance reporting
Features may vary by subscription plan.
4. Subscription & Fees
- Access to MediaPilot requires a paid subscription unless otherwise stated
- Fees are billed monthly or annually via Stripe
- All payments are non-refundable unless required by law
Failure to pay may result in suspension or termination.
5. Bandwidth & Usage
Each plan includes monthly bandwidth limits.
- Usage beyond plan limits will incur overage charges
- Overage is billed at the current published rate (e.g., per TB)
- MediaPilot will provide usage alerts but is not responsible for overages incurred
We reserve the right to throttle or restrict excessive usage.
6. Content Ownership & License
You retain full ownership of your content.
By using MediaPilot, you grant us a limited, non-exclusive license to:
- Host, distribute, and display your content
- Deliver your content across supported platforms
- Monetize your content through advertising
7. Monetization & Revenue
- MediaPilot enables advertising and monetization features
- Revenue may be subject to platform fees or revenue share
- Earnings are based on valid impressions and advertiser demand
- Payments may be withheld or adjusted for invalid traffic or policy violations
MediaPilot does not guarantee revenue, fill rates, or performance.
8. Prohibited Content
You may not upload or distribute content that:
- Violates copyright or intellectual property rights
- Contains illegal, harmful, or deceptive material
- Includes hate speech, explicit violence, or unlawful activity
- Violates platform-specific guidelines (Roku, Fire TV, etc.)
MediaPilot may remove content at its discretion.
9. Platform Compliance
You agree to comply with:
- App store/platform requirements (Roku, Fire TV, etc.)
- Advertising and content standards
- MediaPilot policies and updates
Failure to comply may result in removal or suspension.
10. Account Suspension & Termination
By MediaPilot
We may suspend or terminate your account if:
- You violate these terms
- You fail to pay subscription fees
- Your content or activity poses risk to the platform
By You
You may cancel your subscription at any time. Access continues through the billing period.
11. Data & Analytics
MediaPilot provides analytics for informational purposes only. We do not guarantee accuracy or completeness of reported data.
12. Indemnification
You agree to indemnify and hold harmless MediaPilot from any claims, damages, or liabilities arising from:
- Your content
- Your use of the platform
- Violations of law or third-party rights
13. Limitation of Liability
MediaPilot shall not be liable for:
- Loss of revenue, profits, or data
- Platform downtime or service interruptions
Total liability shall not exceed the amount paid by you in the prior 3 months.
14. Governing Law
This Agreement shall be governed by the laws of the State of Arizona, without regard to conflict of law principles.
15. Changes to Terms
MediaPilot may update these Terms at any time. Continued use of the platform constitutes acceptance of the updated Terms.
